Neutrino API - Terms and Conditions
Firstly, thanks for your interest in our API. The Neutrino API is made available to you on the following conditions. Use of the API constitutes your acceptance of these terms.

1. Access to the API
1.1 When you create an API account you agree to keep your API keys to yourself and secured so that others may not easily obtain them.
1.2 You agree to ensure that your use of the API does not cause excessive resource consumption by opening in excess of 1000 concurrent TCP connections.
1.3 Use the API in any manner or for any purpose that violates any law, regulation or right of any person.
1.4 We may impose limitations on or block your access to the API at any time if you breach these terms, or at our sole discretion.
2. Privacy and Data Protection

3. Intellectual Property
3.1 Intellectual property retrieved through the API or our documentation remains the property of Neutrino API.
4. End-user License Agreement
4.1 The user may create derivative products using our APIs including the data returned from our APIs with the exception of 4.2 below.
4.2 The user may not distribute, resell or transfer bulk API data to anyone other than the Licensee. Bulk API data is any data returned from any API which includes more than one single data record. This includes any API endpoints containing the phrase 'download' or 'dataset' (e.g. 'bin-list-download') as well as any bulk data obtained by storing API response data on your own systems.
4.3 The user may embed our APIs and data into an unlimited number of server-side installations.
4.4 The user may store or cache API response data on your own systems for an indefinite amount of time.
4.5 The user may not embed our APIs into client-side (e.g. JavaScript), desktop or mobile software without the protection of a server-side process or strong encryption. That is, you may not embed your API keys within client-side software without reasonable protection of your API keys.
4.6 The user may not allow anyone other than Licensee, Licensee’s employees, Licensee’s contractors or Licensee’s vendors to access our APIs or data without the suppliers express written permission.
5. Updates to the API and Terms
5.1 We will continue to update the API from time-to-time and may not notify you when we do. If any changes are deemed significant then we will also send email notifications regarding the changes to the API.
5.2 We will avoid making any 'breaking-changes' to the API that would require you to make changes to your applications code. Instead for any potential 'breaking-changes' we will create new API endpoints. The addition of new API response or request fields to an existing API is not considered a 'breaking-change'.
5.3 We will continue to update these terms as our API evolves and we will post those changes on this page. If any changes are deemed significant then we will also send email notifications regarding the changes.
6. General
6.1 We make absolutely no warranties about our API or the data we provide you. However we do our best to ensure our data is accurate and up-to-date at all times.
6.2 Any and all liability and responsibility of Neutrino API to you or in connection with the API, is excluded in respect of any and all loss or damage, whether direct or indirect, including, without limitation, loss of profits, loss of data, loss of business or anticipated savings, general and special damages, and consequential and incidental loss.
6.3 These Terms will be governed by and construed in accordance with the laws of New Zealand.
7. Service Level Agreement (SLA)
7.1 100% availability is our primary goal and we guarantee that our API service will be available at least 99.999% of the time in any given monthly billing period. This mandates that Neutrino API will be unavailable for no more than 5 minutes and 15 seconds per year. If we fail to meet this guarantee, you will be eligible for a credit, as follows: the equivalent of one (1) day's Service Fees for each sixty (60) minutes of API unavailability (or portion thereof), up to one hundred percent (100%) of the Service Fees.
8. Payment Terms and Termination
8.1 Paid accounts operate on monthly terms by default with quarterly and yearly options available.
8.2 You may terminate your account with us at anytime for any reason whatsoever.
8.3 Overdue accounts by default have 30 days to remedy before limiting actions may be taken against the overdue account.
8.4 If you exceed your paid daily quota then overage charges may apply depending on your payment method and account settings. Current overage rates can be viewed at the following URL: https://www.neutrinoapi.com/pricing/
8.5 Overage charges may be completely disabled from the 'Account Profile' area or limited from the 'Daily Limits' area of the account management portal.
9. Abuse
9.1 We reserve the right to cancel the account of any user we, at our sole discretion, deem to be abusing our service for any reason.
